3. Misuse of the DMCA

Please note: Submitting a false DMCA takedown request is a serious offense and may have legal consequences, including liability for damages and attorney fees under Section 512(f) of the DMCA.

Only file a DMCA takedown request if you truly believe the material in question violates your copyright.

4. Counter-Notification Process

If I remove content based on a DMCA request, and the content owner believes it was wrongly accused or removed in error, they may submit a counter-notification as allowed under the DMCA.

That counter-notice must include:

  • Full contact information
  • Identification of the material that was removed
  • A statement under penalty of perjury that the removal was a mistake or misidentification
  • Consent to the jurisdiction of the appropriate U.S. federal court

If a valid counter-notice is received, I may restore the content within 10–14 business days, unless the complaining party files a legal action in court to restrain it.
